Defense attorney Gerald V. Benyo, 45, and a former client, Kendraneshia Barnett, 38, are charged with illegally recording a phone conversation and later providing it in official court documents. Steele overheard Barnett and asked her which deputy took the brass knuckles. Barnett described Bacon, and Steele went to the front doors to talk to her. Steele told Bacon that Barnett is "a nice girl and is working with all of our offices right now on some bigger legal cases. During the conversation, Steele took Barnett's information for an application to be represented by a public defender. Barnett then provided her private defense attorney, Benyo, with the recorded conversation. Police interviewed Barnett in the presence of Beaver county public defenders office on Jan. During the interview, Benyo turned over several pages of text messages exchanged between Steele and Barnett regarding the confiscation and return of her brass knuckles.
Police asked Barnett to allow them to search her phone as part of the investigation. She turned her phone over to police Jan. Within the contents of the phone, Beaver county public defenders office found the referenced text messages and recorded conversation.
Benyo then included the illegally recorded conversation in a motion for an evidentiary hearing on Feb. Benyo, of Dravo Ave. He said that he wants to go to trial before the November election, and that Beaver county public defenders office will not accept any type of plea bargaining. Benyo said the charges will be resolved by a jury trial or full dismissal by the attorney general's office only.
